By placing an order with us, you are stating your agreement to these
Terms and Conditions and are thereby creating a binding legal agreement.

Therefore, you should carefully read the following Terms and Conditions.
By purchasing a Photo Dedication DVD, you signify your agreement to these Terms and Conditions:

RESPONSIBILITY FOR IMAGES
You are responsible for all images you provide to Photo Dedications.com. It is your responsibility to ensure that you are in compliance with copyright law. You must have the right to copy and display each image that you upload, share or print. Professional images that are provided to you by professional photographers or make available through websites, magazines, books, or other sources, may be protected by copyright and should not be provided to Photo Dedications.com. By purchasing a Photo Dedication DVD and submitting any photographs in any form to Photo Dedications.com, you agree that you maintain the copyright for the photographs submitted to Photo Dedications.com. Photo Dedications.com will not accept any photographs that display a copyright watermark on an original hard copy photograph. When submitting professional copyrighted photographs that have been copied or scanned you assume any and all liablity for the photographs that you choose to submit to Photo Dedications.com. Therefore, you agree to release Photo Dedications.com from any and all liability, implied or expressed.

MUSIC COPYRIGHT
To assure that any music featured in a Photo Dedication DVD is legally obtained, all music will be purchased by Photo Dedications.com on your behalf for your own personal use from iTunes. Unfortunately, Photo Dedications.com does not accept music CD's of any kind for the reason that we would be unable to prove to the proper authorities if a question arose that we obtained your music using your music CD. Photo Dedications.com retains all records and receipts from iTunes to prove that any and all music featured in a Photo Dedication DVD is legally obtained for your own personal use. This measure protects Photo Dedications.com and our customers from being sued for copyright infringement. Therefore, by agreeing to these terms and conditions you give Photo Dedications.com permission to purchase music on your behalf from iTunes for your own personal use to comply with music copyright laws.

INDEMNIFICATION
You agree to hold Photo Dedications.com harmless from any liability, loss, claim, and expense, including reasonable attorneys fees, related to your violation or alleged violation of these Terms and Conditions. By placing an order with us, you are also agreeing to indemnify Photo Dedications.com against any liability that might arise as the result of a claim by any third party that inclusion of the materials you supply to us or ask us to purchase on your behalf for use in your Photo Dedication DVD violates any copyright or other right of any third party. Photo Dedications.com expressly disclaims any responsibility or liability to any third party arising out of the content of the materials you supply us or ask us to purchase on your behalf for inclusion in your Photo Dedication DVD, and you agree to be solely responsible as to any such claim. Photo Dedications.com assumes no responsibility or liability with respect to any copyright infringements and the customer hereby agrees to assume all responsibility for any and all costs and expenses incurred by Photo Dedications.com as a result of any legal action or litigation taken against Photo Dedications.com as a result of an alleged copyright infringement. By requesting the services of Photo Dedications.com and in the submission of photographs, slides or photo CD's to us you are stating that you own the copyright or that you have permission to use non-copyrighted photos from any third party. Photo Dedications.com reserves the right to use your production, or parts of your production as a video sample on our web site or to a customer looking for the creating of a similar project. You waive any and all other damages, claims, costs, and attorneys fees.

DAMAGE LIABILITY
Under no circumstances shall Photo Dedications.com be liable for any damages, including but not limited to any direct, indirect, incidental or consequential damages to customers photos (film or digital), slides, videos or and other materials including, but not limited to as a result of theft, fire, flood, natural disaster, war, or terrorism. By purchasing the services and/or products available through this site you are agreeing to all terms and conditions contained herein. Photo Dedications.com shall not be liable for any photos, digital or film, slides, videos or documents while in transit through or in the possession of any mail carrier or courier including but not limited to the U.S. Post Office, Fed Ex, UPS, etc. We will not be liable for any loss, any damage, or any theft of the above mentioned while in transit through or in the possession of any mail carrier or courier. For that reason, we suggest that you consider providing us with a duplicate copy of the photos rather than the original. It is your responsibility to insure the contents of your package, place them in waterproof packaging and to write the words "DO NOT BEND" clearly on the outside of the package. At the very least make sure you protect your precious photos with the proper packing materials. In addition, it is recommended that you ship your package to us using a reliable and reputable shipping service. We will do the same when sending the final product back to you. With all that said, we have never had any problems with damaged original photos or orders when reasonable care is used in packaging and shipping.

FEES AND PAYMENTS
Photo Dedications.com reserves the right at any time to change its fees for services. However, in no event will you be charged a price for services in excess of the amount you have agreed to without your prior agreement to pay such additional charges.

DVD COMPATIBILITY
Photo Dedications uses the DVD+R format which is compatible with over 90% of all existing home DVD players, but not all. Please be sure to check your DVD player manual/manufacturer to determine if it supports DVD+R. Unfortunately, we cannot accept returns or cancel orders after they have been processed and refunds will not be issued for incompatibility reasons.

RESTRICTIONS
Unless otherwise noted, all materials, including, but not limited to, the written content, any images, illustrations, designs, icons, photographs, video clips that are part of the Photo Dedication DVD are subject to copyrights owned by Photo Dedications.com. Producing copies of your Photo Dedication DVD is expressly forbidden without prior written permission from PhotoDedications.com. Modification of the Photo Dedications DVD or use of the Photo Dedications DVD for any other purpose is a violation of Photo Dedications.com copyright and other property rights.

DISCLAIMER
The Photo Dedications DVD is provided AS IS and without warranties of any kind, either expressed or implied to the fullest extent permissible pursuant to applicable law. Photo Dedications.com disclaims all warranties expressed or implied.

MONITORING OF CONTENT
Photo Dedications.com does not control the content of a Photo Dedication DVD and does not, in any event, have any obligation to monitor such contents for any purpose. You acknowledge you are solely responsible for all content and images provided to Photo Dedications.com.

RESTRICTIONS
You must be 18 years of age or older to use our services. Photo Dedications.com does not discriminate against race, creed, sex, or age. However, we reserve the right to refuse any work for any reason at any time. Photo Dedications.com will not accept pornographic material in any form. If sent to us all such material will not be returned but will be destroyed immediately at our discretion and we will not be held liable for any such loss. In addition, for the protection of minors we will disclose any child pornographic material to the proper authorities with all known information of the sender.

Legal Music Notice:
To ensure that any copyrighted music featured in a Photo Dedication DVD has been legally obtained, all music will be purchased by photodedications.com through iTunes on the clients behalf for their own personal use to comply with copyright laws. Photo Dedications does not acquire music through the clients music CD's or by any other means other than ITunes. Photo Dedications retains all music receipts and records from iTunes to prove that all music used has been legally obtained.

Photography Disclaimer:
Photo Dedications will never knowingly accept photographs submitted by our clients that are copyright protected.
Photo Dedications will take every precaution possible to protect copyright protected photos by examining the original hard copy of the photo for a copyright watermark. However, Photo Dedications cannot monitor and will not be held responsible for copyright protected photographs submitted by a client that have been copied or scanned.
The client shall be held responsible and liable for all photographs that they submit to Photo Dedications.
